GENERAL TERMS AND CONDITIONS
1. You will keep safe your online username and password and will not disclose it to others.
2. You will not tamper with or allow others to tamper with the EyesLine Telematics Pvt Ltd products, GPS device installation or data sim cards.
3. You will not remove or allow others to remove the EyesLine Telematics Pvt. Ltd. data sim card from the GPS device or use it for any purpose other than for GPS tracking through EyesLine Telematics Pvt. Ltd.
4. The Sim card provided is the property of EyesLine Telematics Pvt. Ltd. and is solely for the purpose of GPS Tracking/Fleet Management via a Tracking System provided by EyesLine Telematics Pvt. Ltd. If the Sim security sticker present on the tracking unit is found to have been tampered with or removed the customer, then the product warranty will consider to be void. If the device is cancelled or disconnected the sim card must be returned to EyesLine Telematics Pvt. Ltd.
5. You must give EyesLine Telematics Pvt. Ltd. one billing period notice (1st of month to 1st of month) if you wish to terminate your service.
6. If the device fails to track or send data, you must notify EyesLine Telematics Pvt. Ltd. as soon as possible.
7. You cannot claim a refund or credit, if the device has failed to track or send data, unless you notify EyesLine Telematics Pvt. Ltd. in writing immediately and EyesLine Telematics Pvt. Ltd. will assist your notification within 10 days after receiving you in written.
8. You will be charged monthly or yearly in advance for Subscription charges. The first month will be the month the order is placed. It is up to you to ensure your vehicles are available for installation as soon as possible in a safe location with all vehicles at this location unless otherwise arranged with EyesLine Telematics Pvt. Ltd . As each installation is completed the vehicles will only be released and available for use by you and your staff once the devices have been tested on the vehicles on location.
9. Upon termination, you are still liable for any outstanding amounts to EyesLine Telematics Pvt. Ltd. All software, sim cards and data remain the property of EyesLine Telematics Pvt. Ltd. and you have rights to use the software and data when your Subscription fees are paid in full.
10 You expressly acknowledge that due to circumstances often beyond the control of EyesLine Telematics Pvt. Ltd. including (but not limited to) software viruses, power failure, electrical or topological interference, equipment malfunction, tampering by unauthorised persons and the actions and omissions by suppliers of telephone services, software and mapping the EyesLine Telematics Pvt. Ltd. Products and Tracking Software & Telecommunications Services may not operate as designed.
11. You also acknowledge that EyesLine Telematics Pvt. Ltd. is not responsible for damages to the EyesLine Telematics Pvt. Ltd. Products and Software tracking Services or their failure to perform, as a result of any defect in the vehicle or asset being tracked, or by accident, vandalism, tampering or other consequence.
12. You therefore understand and agree that EyesLine Telematics Pvt. Ltd. will not be responsible for any performance, or failure, of the Subscription Services and/or EyesLine Telematics Pvt. Ltd. Products, and any resulting loss of business or profits or other loss or damage whether due to the circumstances envisaged above or otherwise.
13. This order is binding once issued on this EyesLine Telematics Pvt. Ltd. Electronic Online Order Form. EyesLine Telematics Pvt. Ltd. has the right to accept or refuse the order. If you change your mind prior to installation of the EyesLine Telematics Pvt. Ltd. device/s you will be liable for a setup and configuration fee of 5 % of the order value.
14. The prices payable for the EyesLine Telematics Pvt. Ltd. Products and Subscription Services are quoted in this Agreement.
15. Where you pay for EyesLine Telematics Pvt. Ltd. Products Subscription Services, you acknowledge that EyesLine Telematics Pvt. Ltd. is authorised to deduct all due payments on the dates on which they are required to be made. Any dishonoured payments may incur a dishonour fee.
16. Where you wish to stop services with EyesLine Telematics Pvt Ltd (after the applicable termination notice period), you must notify EyesLine Telematics Pvt Ltd in writing of such decision.
17. EyesLine Telematics Pvt Ltd warrants that the products supplied in this agreement are free from defects and defaults and fit for the purpose for which they are intended as of the date of installation.
18. This warranty continues in force for a period from the date of installation of the products in the vehicle or asset. If an author- ised installer removes and refits the products during the warranty period in a new vehicle or asset, then the warranty period will continue to run and the date of installation will be the date of installation in the first Asset nominated by the customer.
19. Customer has to bear the visit charges at the time of Troubleshooting of the device.
20. EyesLine Telematics Pvt Ltd Warranty immediately becomes void if the product found tempered or your vehicle or asset has been involved in an accident or materially damaged. In these instances, the customer will be required to pay for repair or replace- ment of the unit along with the visit charges of Engineer.
21. The warranty offered by EyesLine Telematics Pvt Ltd is a back to base warranty and you are liable to pay any device removal, shipping and re-installation costs.
22. Location Data may not be real time due to factors including but not limited to mobile phone network coverage and/or GPRS, 2G,3G, 4G, Next G or satellite coverage and latency within the Internet or Information Technology Infrastructures.
23. All the legal issues will be taken at Mohali Judicial Court, SAS Nagar Jurisdiction only.
24. All accounts are due seven days from the date of invoicing. Accounts which are due more than 20 days from the date of billing, or more overdue will be suspended and a reactivation fee per device will be payable as well as the regular ongoing monthly service fee. You agree that you will be responsible for all costs and expenses for collection of seriously outstanding accounts.
25. Installation: Support for Installation from the customer. Vehicle Availability at work shop, Mechanical support for removing the diesel tanks, cleaning the diesel tank and fitting the tank back and filling the diesel tank at full from filling station for calibration process of the vehicle. Eyesline Telematics Pvt ltd in not responsible, if the Vehicle manufacturers warranty is voided by installing any eyesline device such as Gps Tracker/ Immobiliser / Fuel Monitoring fuel level system. In Uncontrolled situation the variation of the fuel report may arise. In this installation if vehicle warranty is avoided Eyesline Telematics pvt ltd i s not responsible for that.
26. We agree that EyesLine Telematics Pvt Ltd is authorised to increase the amount on our existing Subscription plan to cover the cost of the GPS devices, accessories, services and monthly fees for this order. Subscription charges will continue to remain in place for the duration written in this order for obtaining and receiving GPS services for fleet and until such time as our account is fully closed and payment is complete under the terms and agreement of sale and as long as the service is provided by EyesLine Telematics Pvt Ltd .
27. EyesLine Telematics Pvt Ltd utilises an online invoicing system and all invoices are sent via email. You agree that you will provide a working email address for the delivery of these invoices. You also agree to notify EyesLine Telematics Pvt Ltd if your email address changes. It is your responsibility to ensure invoices are received and to notify EyesLine Telematics Pvt Ltd if you believe there is a problem with the receipt of these.
28. Once the goods have been sold, will not taken back.
29. Pay timely subscription & Monitoring charges to avoid discontinuity of services.
30. Kindly make the payment of Hardware &Subscription on time to avoid the interest Charges.
31. These All General conditions are applicable for all the Vehicles in which Eyesline Telematic Device is already installed and for the upcoming installations as per future orders placed by customers. And if the customer wants to reinstall the device from previous installed vehicle, then customer is liable to cover the hole in the fuel tank in previous vehicle and have to pay reinstallation charges too.
32. If the customer wants to further install fuel sensors in the vehicles. He has to send the acknowledgement email along with their vehicle numbers.
33. Any Misuse with hardware/Devices is solely responsibility of the customer.
34. After completion of Installation, it is the sole responsibility of customer to submit the documents of vehicle such as Rc OR Invoice of the vehicle purchase to the Eyesline office or by email.
35. Once the diesel tank is dry customer has to clean the diesel tank from his mechanic.
36. Considered mentioned terms &conditions applicable for all branches of client’s whenever they purchase Eyesline Products for other sites.
